Quick Summary: By using Preecode, you agree to these terms. We provide the service on an "as-is" basis, free for personal use during early access. You're responsible for your account security and compliance with laws. Disputes are resolved through binding arbitration.

1. Acceptance of Terms

By accessing, installing, or using Preecode (including the VS Code extension, web dashboard, APIs, and all related services), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use Preecode. Preecode reserves the right to modify these terms at any time with at least 14 days' notice.

2. Service Description

Preecode is a developer activity analytics platform that tracks your coding practice sessions and provides insights into your development progress. Our service includes:

  • VS Code extension for automatic session tracking
  • Web-based analytics dashboard
  • AI code review and suggestions
  • Difficulty distribution analytics
  • Streak and consistency tracking
  • Performance certificates and shareable metrics

The service is provided on an "as-is" basis, free during the early access period. Preecode may introduce paid plans, subscription tiers, or feature changes in the future with advance notice.

3. Your Account & Responsibilities

3.1 Account Creation

You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You agree to provide accurate information during registration and to update it if it changes. You are responsible for all actions taken through your account.

3.2 Eligibility

You must be at least 13 years old to use Preecode (or older if required by your jurisdiction). If you're under 18, your parents/guardians must consent to these terms. Educational institutions may require their own authorization.

3.3 Compliance with Laws

You agree to use Preecode only in compliance with all applicable laws and regulations. You may not use Preecode to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Submit malicious code or attempt to compromise systems
  • Harass, threaten, or abuse other users
  • Reverse engineer or decompile the software
  • Use the service for commercial purposes without authorization
  • Access data or systems without authorization
  • Violate academic integrity policies (if applicable)

4. Intellectual Property Rights

4.1 Our IP

Preecode, including its logo, software, dashboard, AI models, and all content, are the exclusive property of Preecode or its licensors. These are protected by international copyright and trademark laws. You receive a limited, non-exclusive license to use Preecode for personal, non-commercial purposes only.

4.2 Your Content

You retain all intellectual property rights in your code and content. However, by submitting session data and analytics to Preecode, you grant us a worldwide, royalty-free license to:

  • Use your metadata to improve the service
  • Train AI models (using metadata only, never source code)
  • Display your achievements and certificates (respecting privacy settings)
  • Generate aggregated statistics and insights

4.3 AI-Generated Content

Code reviews, suggestions, and practice questions generated by Preecode's AI are provided as supplementary learning tools. Preecode makes no warranty regarding their accuracy or suitability. You are solely responsible for validating AI recommendations before using them in production.

4.4 Open Source

Preecode may include open source components. Applicable open source licenses are provided in the software documentation and override these terms for those specific components.

5. Disclaimer of Warranties

PREECODE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • Preecode will meet your requirements or expectations
  • Preecode will be uninterrupted, secure, or error-free
  • Any defects will be corrected
  • AI-generated content is accurate or suitable for production use
  • Your data will be recovered if lost
  • Third-party services will be available or perform reliably

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PREECODE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL.

Our total liability for any claim is limited to:

  • The amount you paid in the 12 months preceding the claim, or
  • $100 USD if you have not paid anything

These limitations apply even if we have been advised of the possibility of such damages. Some jurisdictions do not permit limitations on liability, so these limits may not apply to you.

7. Indemnification

You agree to indemnify and hold harmless Preecode, its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including attorneys' fees) arising from or related to:

  • Your violation of these Terms
  • Your use of Preecode in violation of laws
  • Your infringement of intellectual property rights
  • Your submission of malicious code
  • Your content or information provided to Preecode
  • Your violation of academic integrity policies
  • Your breach of any representation or warranty made herein

8. Termination

8.1 By You

You may terminate your account at any time from your account settings. Upon termination, your access is immediately revoked. Some data may be retained as required by law.

8.2 By Preecode

Preecode may suspend or terminate your account immediately if you violate these Terms, submit malicious code, engage in harassment, violate laws, commit fraud, or fail to pay subscription fees (for paid plans).

8.3 Effects

Upon termination, your license is revoked, you lose access to your data, and all subscription fees are non-refundable except as required by law. Provisions regarding IP, indemnification, and liability survive termination.

9. Dispute Resolution & Arbitration

9.1 Informal Resolution

Before filing any formal proceeding, you agree to attempt to resolve disputes informally by contacting us at preecodeai@gmail.com. We will attempt to resolve the matter within 30 days.

9.2 Binding Arbitration

Any dispute not resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its rules, except that small claims (under $5,000 USD) may be brought in small claims court.

9.3 Class Action Waiver

You agree not to participate in class action or collective action lawsuits. All disputes must be resolved individually through arbitration or small claims court.

10. Governing Law

These Terms are governed by the laws of the United States of America, specifically the state where Preecode's principal place of business is located, without regard to conflict of law principles. You consent to the exclusive jurisdiction of federal and state courts in that jurisdiction.

11. General Provisions

11.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Preecode regarding the service and supersede all prior agreements.

11.2 Severability

If any provision is found unenforceable, that provision is severed, and the remaining provisions continue in full force.

11.3 No Waiver

Preecode's failure to enforce any right does not constitute a waiver of that right or any other provision.

11.4 Assignment

You may not assign these Terms without Preecode's written consent. Preecode may assign these Terms to any successor or affiliate.
